IRS updates overtime-deduction rules: report qualified OT in W-2 Box 12 Code TT

On Aug 6, 2026 the IRS issued Fact Sheet FS-2026-13, replacing its January guidance on OBBBA's new deduction for qualified overtime compensation. Employers must now separately report qualified overtime on Form W-2, Box 12, using Code TT, reporting the full qualifying amount even if the worker's deduction is capped or phased out. Errors require a corrected Form W-2c, and the compliance rules apply for tax years 2026 through 2028.

Why this matters for founders

If you pay any FLSA overtime, tell your payroll provider now to enable Box 12 Code TT tracking for 2026 W-2s and don't cut withholding unless the employee files an updated W-4 claiming the deduction.
