SR&ED enhanced 35% credit limit doubles to $6M; CRA adds pre-claim approval

Under Bill C-15 (Royal Assent 26 March 2026), the enhanced 35% refundable SR&ED investment tax credit's annual expenditure limit doubled from $3M to $6M, with the phase-out taxable-capital range widened to $15M-$75M, for tax years beginning after 15 December 2024. The CRA also launched an optional pre-claim approval process on 1 April 2026 giving an eligibility determination within eight weeks before costs are incurred, and capital expenditures made after 15 December 2024 are once again claimable.

Why this matters for founders

A pre-revenue Canadian-controlled private corporation can now claim the full 35% refundable credit on up to $6M of eligible R&D, and can lock in eligibility via pre-claim approval before spending. Re-scope 2025-2026 R&D budgets and file for pre-claim approval to de-risk the claim.
