FTC and 22 states sue Amazon over hidden ad-auction surcharges topping $20B

On 31 August 2026 the FTC and 22 state attorneys general sued Amazon in the Western District of Washington, alleging it secretly manipulated Sponsored Products, Sponsored Brands, and Sponsored Display auctions to overcharge about 1.2 million advertisers by more than $20 billion since 2019. The complaint says the price advertisers paid was a calculated 'proxy 2nd price,' not set by real bidders.

Why this matters for founders

Founders who buy Amazon retail ads should audit historical Sponsored Ads spend and watch for a claims/restitution process, and treat marketplace ad-auction opacity as a real budgeting risk.
